买卖虚拟币是假 转移赃款是真

晚报讯 单纯买卖虚拟币也会构成犯罪吗？如果交易资金来源是犯罪所得，而交易人又知晓资金来源，那么该交易行为就可能构成犯罪。记者昨天了解到，通州法院审理了一起打着虚拟币买卖幌子给诈骗分子“洗钱”的掩饰、隐瞒犯罪所得罪案件。

Is it also a crime to simply buy and sell virtual currency? If the transaction is financed by the proceeds of crime and the dealer knows the source of the funds, the transaction may become a crime.

2022年11月至2023年8月，男子王某福及王某标、王某平（均另案处理）3人商议通过欧易平台进行USDT虚拟币买卖，约定王某福、王某平共同出资25万元、王某标出资11万元，分别操作各自账号进行交易，获利由3人平分。

所谓虚拟币买卖，其实就是王某福等人为诈骗分子转移诈骗资金的一种手段，诈骗分子用赃款向王某福等人购买虚拟币，从而达到洗钱的目的，而王某福等人则从中赚取差价获利。

The so-called virtual currency sale is in fact a means by which Wang and others transfer fraudulent funds for the benefit of fraudsters who buy virtual currency from Wang and others for the purpose of money-laundering, from which Wang and Fukuk profit the difference.

法院在审理中查明，2023年7月至11月，王某福提供多个微信号用于收取虚拟币交易资金，通过数字货币交易平台在场内、场外交易，为诈骗分子转移诈骗资金，共计人民币38万余元，从中非法获利12000余元。

During its proceedings, the Court found that, between July and November 2023, Wang Favour had provided several micro-signals for the collection of funds from virtual currency transactions, and had transferred fraudulent funds for fraudsters, both on-site and off-site, for a total of more than RMB 380,000, from which he had illegally earned over RMB 12,000.

法庭上，王某福坦白道，自己在进行第一笔虚拟币交易时就发现对方资金来源是诈骗所得，并提醒同伙王某标，但王某标表示，他们作为商家只是单纯进行交易从中赚取差价而已。

In court, Wang Fook confessed that he himself had discovered that the source of funds for the first virtual currency transaction was the proceeds of fraud, and reminded the partner of the bid, but he indicated that as a businessman, they had merely earned the price difference from the transaction.

公诉机关以掩饰、隐瞒犯罪所得罪对王某福提起公诉。目前，法院对该案正在进一步审理中。

The Public Prosecution Service prosecutes Wang Fook for covering up and concealing the proceeds of crime.

法官提醒，虚拟货币不具有法偿性与强制性等货币属性，不具有与货币等同的法律地位。参与虚拟货币投资交易活动本身就存在法律风险，若是用来给赃款洗钱，那更逃不了法律的制裁。

The judge cautions that a virtual currency has no legal status equivalent to that of a currency, such as legal equivalency and mandatoryity. Participation in a virtual money investment transaction is in itself a legal risk, and if it is used to launder stolen money, it is not immune from the law.
