币圈400亿传销盘判了！头目海外挥霍上亿元，260万人被坑

Plustoken会员上缴的数字币会费价值逾400亿，幕后诈骗团伙早早逃往国外，大肆挥霍，光房子就买了十几套。案发后，被查获的百亿数字币上交国库，260多万会员欲哭无泪。

After Plustoken paid over 40 billion dollars in digital money, behind-the-scenes fraud groups fled the country early and squandered their lives, buying more than a dozen units of houses alone. After the incident, the 10 billion dollars seized were handed over to the treasury, and more than 2.6 million members were crying.

时隔一年多，跑路被抓的币圈传销盘Plustoken迎来终审判决，也揭开了这一庞氏骗局背后操盘人的奢靡生活。

More than a year later, Plustoken, who had been caught running for money, had come to a final judgement, which had also exposed the luxury of the man who was behind the Ponzi scheme.

11月26日，盐城市中级人民法院公开了陈波、丁赞清等组织、领导传销活动罪二审刑事裁定书，决定维持一审判决，主犯陈波被判处11年有期徒刑，并处以600万元罚金。

On 26 November, the Intermediate People's Court of Salt City made public the criminal verdict of the second instance for the crimes of Chen Bo, Tin Zanqing and other organizations, leading the distribution activities, and decided to uphold the first-instance judgement. The principal was sentenced to 11 years'imprisonment and a fine of 6 million yuan.

2018年，仅有初中文化的陈波领头，搭建了一个令200多万人卷入、涉案金额超过400亿的惊天骗局。

In 2018, Chen Bo, the only leader of junior secondary education, set up a hoax scheme involving more than 2 million people and involving more than 40 billion people.

陈波用骗来的数字货币变现后，购豪车、豪宅、送女友父母超过1000万，挥霍钱财后，为自己和同伙办好了外国国籍跑路国外。

When Chen Bo cashed in the digital currency he bought luxury cars, mansions, sent over 10 million parents to his girlfriend, and then spent money on his own and his associates to run abroad for foreign nationality.

一年多后，公安机关跨国追捕，这群骗子锒铛入狱，超百亿虚拟货币赃款全数上缴国库。

More than a year later, the public security organs pursued them across national borders, and these liars were jailed and more than 10 billion dollars of the counterfeit money was paid in full to the national treasury.

披上区块链外衣的传销盘

2018年初，数字货币概念大热时，初中文化水平的陈波想到了一个发财的路子，借区块链噱头搞网络传销。

In early 2018, at a time when the concept of digital currency was hot, Chen Bo, a junior high school-level teacher, thought of a lucrative path to distribution of the Internet by means of a chain of blocks.

他先后找来郑敬、王仁虎两名专业人士设立网站和APP，搭建了一个叫做PlusToken的平台，全称为“PlusToken数字货币搬砖套利量化交易钱包”。个人能力有限，陈波还拉拢了丁赞清、袁园、王仁虎等本科学历的人入伙。

He came to Chengzheng and Wang In-ho, two professionals, to set up websites and APPs, and set up a platform called PlusToken, known as the “Plus Token Digital Money Moves Bricks and Quantified Trading Wallet.” With limited personal capacity, Chen Po also brought together people from his scientific history, such as Tin Zanqing, Yuan Park and Wang In-ho.

与此同时，该平台的最高市场推广团队、客服团队、拨币小组也组建了起来，通过微信群、网络、会议、演唱会、旅游等方式大肆宣传PlusToken平台的奖金制度、运营模式和发展前景，一场庞氏骗局的大幕就此拉开。

At the same time, the platform's top marketing team, the client service team, and the coin-dial team have been formed to promote the PlusToken platform's bonus system, business model and development prospects through micro-credits, networks, conferences, concerts, tourism, and so on, with the opening of a Ponzi scheme.

PlusToken平台对外宣称可以提供数字货币增值服务，就是用户将自己购买的比特币、以太坊等主流币转账到PlusToken上，获取对应比例的分红——Plus币。这一招，很可能是从余额宝那里学来的。

The PlusToken platform, which claims to provide digital value-added services, is that users transfer to PlusToken the main currency they buy, such as bitcoin, and the Taiku, to get the proportional share of the bonus — Pluscoin . This move is probably learned from the balance.

Plustoken在白皮书介绍中宣称，投资者存入100万元，复利一年就能赚到700万元。开出如此惊人的收益率，那些暴雷的P2P都要往边上靠一靠。

Plustoken, in his presentation to the White Paper, claims that an investor deposits $1 million and a compound gain of $7 million a year. At such an amazing rate of return, those thunderstorming P2Ps have to lean on the edge.

不过，用户要想加入PlusToken，可是要缴纳门槛费的——参加者通过上线的推荐取得该平台会员账号，还要缴纳价值500美元以上的数字货币，并且要开启“智能狗”，才能获得平台收益。

However, if users want to join PlusToken, they will have to pay the threshold fee — participants will obtain the platform's membership number through online referrals, they will have to pay digital currency worth more than $500, and they will have to open “smart dogs” in order to be able to reap the platform's benefits.

什么是“智能狗”呢？因为币圈专业人士都懂，加密数字资产本就没有利息这一说。为了让用户更加信服，该平台以“智能狗搬砖”的功能（即同时在不同交易所进行套利交易，赚取差价）作为盈利噱头。

What is a "smart dog"? Because currency-circumstance professionals know that there is no interest on encrypted digital assets. To make users more convinced, the platform uses the function of a "smart dog moving bricks" (i.e. trading arbitrage on different exchanges at the same time, earning differentials) as a profit.

该功能宣称，除保本以及Plus币升值产生的收益外，参与者还能获得8%-30%的月收益。

The function asserts that, in addition to the gains from the preservation of the capital and the appreciation of the Plus currency, participants will receive a monthly return of 8-30 per cent.

不可否认的是，市场上不同的交易所确实是存在价差，并且在币圈已形成了一套成熟的搬砖模式。去年7月，无冕君在报道中还认真测算了这个“搬砖”业务，搬砖获利月化收益率很难超过3%，不能覆盖平台给出的高回报。

Undeniably, different exchanges in the market do have price differentials and have developed a mature model for moving bricks in the currency circles. Last July, the coronary carefully measured the “brick move” in his report.

PlusToken是一个彻彻底底的靠拉人头、发展下线，用新参与者的钱支付旧参与者利润的传销盘。

PlusToken is a bottom-up distribution board that pulls heads, develops lines and pays for the profits of the old participants with the money of the new participants.

根据终审判决书，该平台会员间分为上下线层级，并根据发展下线会员数量和投资资金的数量，将会员等级分为普通会员、大户、大咖、大神、创世五个等级，没看十部修仙小说的领导者，都设计不出这样的级别名称。对外称有智能搬砖收益、链接收益、高管收益等三种主要收益方式，以此进行返利，直接或者间接以发展人员数量及缴费金额作为返利依据。

According to the final judgement, the platform’s membership is divided into top-down and bottom-up levels, and, depending on the number of members below the development line and the amount of investment funds, it is divided into five ranks: ordinary members, large households, big curry, big gods, and creative world leaders, who do not look at ten fairy novels, and cannot be named as such. Three main ways of reaping the benefits are referred to, either directly or indirectly, in terms of the number of development personnel and the amount of contributions.

2018年7-8月，先后在韩国和香港路演和推广。9月14日，在韩国济州岛某酒店举行“PlusToken”全球启动仪式。

“PlusToken” global launch was held on 14 September at a hotel in Jeju Island, Korea.

在大力宣传和高额反佣的吸引下，2018年4月到2019年6月，一年多的时间里，以陈波为首的PlusToken便吸纳了269万名会员，其中最大层级为3293层。

During the period from April 2018 to June 2019, the PlusToken, headed by Chen Bo, absorbed 2.69 million members, the largest of which was 3293 floors.

大量的会费也给PlusToken带来了巨量的财富，截至2019年6月27日，PlusToken平台共收取会员缴纳的比特币（BTC）约31万个、比特现金（BCH）约12万个、达世币（DASH）约10万个、狗狗币（DOGE）约110亿个、莱特币（LTC）约185万6个、以太坊（ETH）约917万个、柚子币约（EOS）5136万个、瑞波币约（XRP）9亿个。2019年6月28日后，仍有非法数字货币转入平台的钱包地址。

A large amount of contributions has also brought enormous wealth to PlusToken. As of 27 June 2019, the PlusToken platform had received approximately 310,000 bitcoin (BTC) from its members, 120,000 bit cash (BCH), 100,000 DASH (DASH), 11 billion dogs (DOGE), 185 million LTC (LTC), 9.17 million Ether (ETH), 51.36 million prunes (EOS) and 900 million rippoons (XRP). After 28 June 2019, illegal digital currency was transferred to the platform with wallet addresses.

将这些数字货币换算成人民币，按当时的价格算就已经超过了400亿元。这是一个什么概念呢？2019年《财富》中国500强中，一多半的企业年营收都不及400亿。如果按目前的数字货币价格算，PlusToken收的会费还得翻几番。

Translating these figures into the renminbi, at that price already exceeds 40 billion yuan. What is the concept? In 2019, of China’s top 500, more than one and a half businesses won’t earn as much as 40 billion dollars a year.

办好绿卡跑路，至少1.27亿被挥霍

Green Card Run, at least 127 million wasted

与P2P大案“e租宝“的情节相似，PlusToken平台会员缴纳的亿万资产被陈波一手掌控，其变现后用作个人投资、购豪车、豪宅、送给女友，以及分配给丁赞清、彭一轩等人肆意挥霍。

Similar to the circumstances of the P2P case of “e-rents”, the hundreds of millions of assets paid by members of the PlusToken platform were controlled by Chen Bo, whose realization was used for personal investment, purchase of luxury cars, mansions, giving to girlfriends, as well as for wanton squandering of others such as Tin Zanqing and Peng Yi Qing.

陈波在柬埔寨花了1600多万投资房地产和娱乐城。2019年1月，为逃避法律打击，陈波、其女友袁园将平台客服组、拨币组搬至柬埔寨西哈努克城BS别墅区及宝迈娱乐城，并继续以PlusToken平台进行传销活动。

Chen Bo spent more than 16 million on investment in real estate and entertainment in Cambodia. In January 2019, in order to escape the law, Chen Bo, his girlfriend Yuan Park moved the platform's customer service group, the dial-up group to BS villa in Sihanouk City, Cambodia, and the Bomay Recreation City, and continued its distribution campaign on the PlusToken platform.

根据终审判决书显示，陈波除了用数字货币用支付PlusToken的推广费用、工作人员的费用外，还将数字货币变现。已查出的是，其通过卖币变现1.45亿元人民币，现有证据已查明其中1.27亿元已经被其挥霍。

According to the final judgement, Chen Bo, in addition to paying PlusToken’s promotional costs and staff costs in digital currency, realized the digital currency. found that it had converted 145 million yuan by selling currency, of which the available evidence had found that 127 million yuan had been squandered by it .

陈波女友袁园负责管理PlusToken平台后台工作组员工，为员工提供租房、发放工资等后勤保障，并协助管理财务工作。在长沙的橘子洲头边，陈波给女友父母花了600多万购屋，前前后后一共给其父母超过1000万人民币。

Chen Bo’s girlfriend Yuan Park is responsible for managing the employees of the PlusToken platform’s back-office team, providing them with logistical support such as renting, paying their salaries, and helping to manage their finances. On the head of the Orange continent in Changsha, Chen Bo spent more than 6 million dollars on their girlfriend’s parents, after which they were given more than 10 million yuan.

前有“e租宝”的丁宁给情妇送名牌包，后有PlusToken陈波给女友父母购豪宅，看来骗子依旧难过美人关。

Tinning, formerly “e-leased” gave her a name card bag, followed by PlusToken Chenbo, who bought a big house for her girlfriend's parents, and it appears that the liar remains upset about the beauty of the house.

陈波还花费将近2000万在长沙购置了11套房产，分别挂在其父亲、叔叔、弟弟、奶奶等亲属的名下；又给弟弟、搭档分别购置豪车、亲属转账超过3000万元；还给袁园、丁赞清、彭一轩、王仁虎购买金边公寓共7套，花费近千万元。

Chen Bo also purchased 11 properties in Changsha, in the name of relatives such as his father, uncle, brother, grandmother, at a cost of nearly 20 million; another over $30 million was purchased for his brother, partner and relative; and 7 apartments in Phnom Penh were purchased for Yuan Garden, Tin Zanqing, Peng Yi-chung and Wang In-ho, at a cost of almost $10 million.

除了陈波之外，PlusToken的另外几位操盘手同样通过变现数字货币，从中获利数百万元不等。

In addition to Chen Bo, several other PlusToken players also profit from the same amount of money through the realization of digital currency, ranging from millions of dollars.

尽管这几位操盘手策划并设置“关狗手续费”、“挖矿”、“币融”等功能以延缓平台崩盘，但陈波已为自己和几位搭档找好了退路。他用200多万元为丁赞清、彭一轩、陈波、袁园等人办理瓦努阿图绿卡，又花费近500万元用于办理他本人、袁园、彭一轩等人的瓦努阿图护照。

Although these masters planned and set up functions such as “custody fees”, “mining mining”, and “coin melting” to slow down the platform’s collapse, Chen Bo has found a way out for himself and several partners. He used more than 2 million dollars to process Vanuatu green cards for Ting Qing, Peng, Chen Bo, Yuan Park, and others, and spent nearly 5 million dollars on Vanuatu’s passports for himself, Yuan, Peng, Peng and others.

天网恢恢，疏而不漏，这群人还沉浸在暴富的喜悦中的时候，公安机关已经盯上了他们。

The public security authorities were already following them when the Skynet was restored and the crowd remained immersed in the joy of the rich.

2019年初，江苏盐城公安机关发现陈某等人涉嫌利用虚拟币交易平台组织领导传销犯罪的线索后，立即成立专案组。同年6月27日，专案组民警分赴南太平洋岛国瓦努阿图、柬埔寨、越南、马来西亚等国家和地区，配合当地警方将藏匿在境外的27名主要犯罪嫌疑人抓获归案。

At the beginning of 2019, as soon as the Jiangsu Salt City public security authorities discovered that Chen and others were suspected of using virtual currency trading platforms to organize the distribution of the crime, a task force was formed. On 27 June of the same year, the task force sent police officers to various countries and regions of the South Pacific island, including Vanuatu, Cambodia, Viet Nam, and Malaysia, to cooperate with the local police in apprehending 27 major suspects who were hiding outside the country.

在陈波等人被抓后，操盘手陆姣龙与刘帅、陈滔等人合谋，转移、窝藏PlusToken非法所得的数字货币（案发时价值1.5亿余元），最终造成456个比特币、573181.4个柚子币以及911个以太坊损失。

After his capture, Chen Bo and others conspired to transfer and harbour the digital currency illegally acquired by PlusToken (with a value of over 150 million yuan at the time of the incident), resulting in 456 bitcoins, 5731,184.4 grapes and 911 Ethals.

2020年3月，公安部部署全国公安机关发起集群战役，将涉嫌传销犯罪的82名骨干成员全部抓获。

In March 2020, the Ministry of Public Security deployed the national public security organs to launch a cluster campaign to capture all 82 key members suspected of spreading the crime.

在一审被告不服上诉后，2020年11月，币圈传销盘第一大案终于迎来了终审判决。据江苏省盐城市中级人民法院二审裁定，驳回上诉，维持原判。PlusToken的操盘人陈波犯组织、领导传销活动罪，判处有期徒刑11年，并处罚金人民币600万元，其余十多名被告人被判处2-8年不等的有期徒刑。法部门从7名罪犯账户查获部分加密资产，被查获的数字货币将依法处理，所得收益将被没收，上缴国库。该裁定为终审裁定。

After the first-instance defendants appealed, a final decision was reached in November 2020 in the first case of currency circulation. According to the second instance ruling of the Intermediate People’s Court of Salt City, Jiangsu province, the appeal was dismissed and the sentence upheld. The PlusToken operator Chen Bo, who organized and led the distribution campaign, was sentenced to 11 years’ imprisonment and a fine of 6 million yuan, and the remaining 10 defendants were sentenced to terms of imprisonment ranging from 2 to 8 years. The legal department seized part of the encrypted assets from the accounts of seven offenders, the digital currency seized will be dealt with in accordance with the law, and the proceeds obtained will be confiscated and handed over to the State Treasury.

曾有币圈人士告诉无冕君，“资金盘（传销盘）与正规交易所不同，交易所可以盈利，比如收取交易手续费、项目上线费等，与传统的股票交易所一样。而传销盘没有盈利能力，只是人拉人击鼓传花的游戏，一旦人数不足就面临崩盘的后果，结果只有跑路。”

在这一场传销骗局中，后进入的会员注定被割韭菜，有参与PlusToken的会员则表示，“传销没有受害者，只有参与者。如果我们早知道这是传销，也不会加入的。”

In this scheme, members who enter later are destined to be cut off, and those who are involved in PlusToken say, “The distribution has no victims, only participants. If we had known it was a distribution, we would not have joined

北京市隆安律师事务所金融律师张特表示：“因为加入传销组织不是合法的投资，参与者获得的利益，比如说返利等不是合法的投资，所以参与者的投资利益、投资所得法律不予保护。按照《刑法》第64条，此时传销所得的财务都应该追缴，最后收归国库。”

“As membership in a distribution organization is not a legitimate investment, the interests of the participants, such as return money, etc., are not lawful investments, the law does not protect the investment interests of the participants and the income derived from the investment. In accordance with article 64 of the Criminal Code, the proceeds of the transfer should then be recovered and eventually returned to the treasury.”

值得一提的是，PlusToken并非个例，在数字货币日益火爆的当下，还有不少披着区块链马甲行骗的各类传销盘。因此，当各位遇到高收益高回报、保本等投资宣传时，还需擦亮眼睛，仔细鉴别。

It is worth mentioning that PlusToken is not an example of a time when digital currencies are becoming more hot, and there are a lot of different distribution boards that have been deluded in the form of block chains. So, when you are confronted with high returns, insurance, etc., you need to nuance your eyes and identify them carefully.
